Terms of Service

You may use Destiora for lawful travel discovery, planning, collaboration, and safety research. You must be at least 18 years old, or the age of majority in your jurisdiction, to use Destiora. You are not permitted to create or use an account if you are under 18. If we learn that an account is used by a person under 18, we may suspend or delete the account and related information as described in our Privacy Policy. You are responsible for all activity under your account and for keeping your credentials secure. Notify us at legal@destiora.com if your account is compromised. You agree not to misuse the service through scraping, reverse engineering, impersonation, unauthorized access, interference with platform security, or any unlawful activity.

Safety scores, destination rankings, itinerary suggestions, and trip-planning recommendations are decision-support information only. They may be generated from third-party data, automated systems, artificial intelligence, user inputs, and other available signals. They are not guarantees of safety, availability, price, legal compliance, accessibility, suitability, or travel quality.

Real-world conditions can change quickly, including weather, closures, crime, health conditions, transportation disruptions, political events, and local rules. You remain solely responsible for verifying travel details, checking official sources and advisories, confirming prices and availability, and making your own travel decisions.

Destiora does not provide law-enforcement, intelligence, emergency, insurance, medical, legal, visa, immigration, or licensed travel-risk advisory services. Nothing on the service creates a professional advisory, fiduciary, or emergency-response relationship. In an emergency, contact local emergency services or the appropriate authorities.

Travel involves inherent risks, and you are responsible for your travel choices.

To the maximum extent permitted by law, you assume all risks arising from destinations, travel routes, accommodations, transportation, events, local conditions, health conditions, weather, crime, civil unrest, border rules, cancellations, delays, and other travel-related circumstances. Destiora may help you research and compare options, but it does not control real-world conditions or guarantee that any place, listing, itinerary, route, or activity is safe or suitable.

To the maximum extent permitted by law, you release Ginovate LLC and its affiliates, officers, employees, contractors, and agents from claims arising from physical injury, illness, death, property loss, financial loss, travel disruption, or other harm connected to travel decisions you make using or after viewing Destiora information.

Planhub allows users to plan trips collaboratively. A trip organizer may invite collaborators or viewers, set planning deadlines, review feedback, make final selections, and manage trip decisions. Collaborators may submit preferences, react to recommendations, vote, comment, suggest alternatives, and view shared trip materials according to their permissions. Viewers may access read-only trip information where sharing is enabled.

Content shared in a Planhub may be visible to other invited participants based on role and sharing settings. Late joiners continue from the current state of the discussion and do not automatically reset recommendations, votes, or itinerary decisions. Destiora may help organize group input, but the organizer and participants remain responsible for final travel choices, bookings, payments, and offline arrangements.

You retain ownership of content you submit to Destiora, including preferences, comments, votes, saved places, itinerary details, uploaded materials, and other trip-planning content (“User Content”). By submitting User Content, you grant Ginovate LLC a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, transmit, and share that User Content as necessary to operate, secure, improve, and provide Destiora, including displaying it to invited Planhub participants according to your sharing settings and role permissions.

You represent that you have the rights needed to submit your User Content and that it does not violate the rights of others or applicable law. We may remove or restrict User Content that violates these Terms, creates risk, or harms the service or other users.

Destiora relies on third-party providers for services such as mapping, payments, hosting, analytics, communications, safety data, artificial intelligence, and other infrastructure. Third-party data may be incomplete, delayed, inaccurate, unavailable, or subject to separate terms and policies. We are not responsible for the acts, omissions, content, availability, or policies of third-party providers.

If you follow links, use external booking services, or complete transactions outside Destiora, those activities are governed by the applicable third party’s terms and policies.

Paid plans are billed through Stripe or another payment processor on a recurring basis unless otherwise stated at purchase. By subscribing, you authorize recurring charges for the selected plan, applicable taxes, and any permitted fees until you cancel. You may cancel through your account settings or by contacting legal@destiora.com if in-product cancellation is unavailable.

Cancellation stops future recurring charges after the current billing period, but does not automatically refund amounts already paid unless required by law or expressly stated at purchase. Pricing, plan features, trial terms, and billing intervals may change with appropriate notice where required. We may suspend or cancel access for failed payments, abuse, fraud, chargebacks, or Terms violations.

You may not use Destiora to harm the service, other users, third parties, or travel partners. You may not post unlawful, infringing, abusive, harassing, misleading, malicious, or privacy-invasive content; interfere with platform operations; attempt unauthorized access; harvest user data; or use Destiora in a way that violates applicable law.

We may investigate misuse and suspend, restrict, or terminate access to protect platform security, users, third parties, or Ginovate LLC. We may preserve or disclose information when required by law, to enforce these Terms, or to protect rights, safety, and security.

The service, software, content, design, trademarks, brand elements, data compilations, scoring methodologies, and related materials are owned by Ginovate LLC or its licensors. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use Destiora for its intended purpose. No ownership rights are transferred.

You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from Destiora except as permitted by law or with our written permission.

These Terms work together with our Privacy Policy and Cookie Policy. Those policies explain how we collect, use, share, and protect information, including account information, travel preferences, Planhub content, usage data, cookies, and information processed by third-party service providers. By using Destiora, you acknowledge that your information will be handled as described in those policies.

Destiora is provided “as is” and “as available,” without warranties of any kind.

To the maximum extent permitted by law, Ginovate LLC disclaims all express, implied, statutory, and other warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.

We do not warrant that the service will be error-free, secure, uninterrupted, or that any safety score, recommendation, itinerary, listing, price, availability, or third-party data will be complete, current, accurate, or suitable for your needs.

To the maximum extent permitted by law, Ginovate LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes damages from use of or inability to use Destiora; reliance on safety scores, AI outputs, recommendations, listings, or third-party data; travel disruptions; cancellations; theft; injury; property loss; lost profits; lost data; or actions of other users or third parties. Total aggregate liability is capped at the greater of (a) amounts paid to Ginovate LLC in the 12 months before the claim, or (b) USD $50.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, such as liability for fraud or gross negligence where such exclusions are not permitted.

You agree to defend, indemnify, and hold harmless Ginovate LLC and its affiliates, officers, employees, contractors, and agents from claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of:

• your use of the service;
• your violation of these Terms or applicable law;
• your User Content;
• your interactions with other users or third parties; or
• your travel decisions made in connection with Destiora.

Before filing a formal claim, you agree to contact legal@destiora.com and attempt good-faith informal resolution.

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law rules. Disputes not resolved informally must be brought in the state or federal courts located in North Carolina that have jurisdiction over Ginovate LLC and the dispute, unless applicable law requires a different forum.

We may update the service and these Terms from time to time. Material changes will be reflected by an updated version or date and, where appropriate, notice through the service, email, or another reasonable method. Continued use after updated Terms take effect constitutes acceptance. We may modify, suspend, or discontinue features of Destiora as the service evolves.

We will not be responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet or utility failures, third-party service interruptions, government actions, public health events, or other force majeure events.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be interpreted or limited to the extent necessary to make it enforceable. Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction.

These Terms, together with the Privacy Policy, Cookie Policy, and any product-specific terms presented to you, are the entire agreement between you and Ginovate LLC regarding Destiora and replace prior or contemporaneous understandings about the service.
